LocalMotion offers skills based volunteering, that helps charities and social enterprises complete short-term skilled projects and allows professionals to contribute their skills to causes they care about. These terms and conditions (“Terms”) apply to any person (you or your) accessing or using the website www.localmotion.hk (“Site”), operated by LocalMotion. By accessing and using this Site, you are indicating your consent to be bound by and accept these Terms. Your continued use of the Site shall constitute your acceptance to these Terms.

Community Rules

LocalMotion is creating a kind community. By using this Site or creating an account you agree that you will follow and adhere to the Community Rules (“Rules”), namely :-

• that you will treat other Site users with respect;
• that you will not stalk, harm or harass any other individuals or users of this Site;
• that you will not misrepresent your skills, experience or affiliations;
• that you will not impersonate anyone;
• that any information submitted to this Site, whether to register your account or update on a project, is true and accurate to the best of your knowledge;
• that you will not collect and/or store personal data of other Site users;
• that you will not contact Site users through other channels apart from the functions available on this Site; and
• that you will note violate the terms of your visa (if applicable), as you engage in or offer any skills based volunteering opportunities located in Hong Kong.

If you fail to adhere to any of the Rule or Terms, you will be suspended from using the Site. If you use our Site and/or our intellectual property in an unauthorised manner, LocalMotion reserves the right to make a claim for damages or report any criminal behaviour.

Account, Password and Security

Access to certain parts of this Site requires you to register an account with LocalMotion. You may access those certain parts of the Site using your username and Password, set up by you.

Your account is personal to you and is not transferable. You are responsible for keeping, protecting and securing your username and Password from unauthorised use and disclosure. You agree to take all responsibility for all statements made, all acts or omissions that occur and all activities that take place under or through your account, and to notify us immediately upon you becoming aware of, or if you believe there has been, any unauthorised use of your account or any other breach of security for any of your information stored on the Site.

You may not use anyone else’s account or Password at any time without the express permission and consent of the holder of that account or Password. LocalMotion cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

LocalMotion reserves the right to take any action we deem appropriate on receiving notification from you of unauthorised use of your account or a breach of security.

Limitation of Liability

To the extent permissible by law, you agree to indemnify LocalMotion, its affiliates, officers, directors and employees from and against any and all third party claims, liabilities, losses, damages, costs expenses and fees that may arise. LocalMotion reserves the right to add, modify or remove any of the information or material available on the Site at any time.

Viruses & Compatibility

LocalMotion has taken appropriate steps to detect computer viruses but does not warrant that the Site or content available on the Site is error-free or will be uninterrupted, free from spyware, malware, adware, viruses, worms or other malicious code, or will function to meet your requirements. LocalMotion shall not be liable for any loss or damage which occurs as a result of any virus or other technologically harmful material that may infect your computer equipment, computer programs, data or other materials. You are responsible for configuring your information technology, computer programmes and platform in order to access the Site and for protecting these with your own anti-virus software, firewalls and any other technical measures.

Some links within the Site, may lead to other websites owned and operated by third parties. LocalMotion is not responsible for their content and does not necessarily sponsor, endorse or otherwise approve of the materials appearing in such websites. In addition, linked websites may be subject to terms of use and/or privacy policies of their owner/operators, and anyone who uses such a link is responsible for checking what those terms/policies are for themselves. Furthermore, the opinions expressed in materials transmitted from the Site are the opinions of the individual author and may not reflect the opinions of LocalMotion or any of its officers, directors, employees or agents.

Intellectual Property & Use of Material

The contents of this Site are either owned or licenced by LocalMotion, in addition the contents, including but not limited to text, software, photographs, graphics, illustrations, artwork, video, music, sound, names, logos, trademarks, service markets and other material and content (collectively the “Materials”) are protected by copyright, trademarks, service marks, patents or other proprietary rights and laws internationally. This includes both content owned by LocalMotion and content owned or controlled by third parties and licenced to LocalMotion.

You may not make copies, print or download material published on this Site without express written permission. If you wish to share materials from the Site, including videos from Social Enterprises or Charities, please seek permission by contacting us at getinvolved@localmotion.hk.

LocalMotion permit users of the Site to share job descriptions. However, LocalMotion reserves the right to withdraw these permissions in relation to any particular user at any time.

As a condition of your use of this Site, you agree that you will not use the Site for any purpose that is unlawful or prohibited by any applicable laws or the terms, conditions, and notices contained herein. Without limiting the generality of the foregoing, you further agree not to:

• sell or modify all or any part of the Materials or post, publish, transmit, reproduce, display, publicly perform, distribute, exploit, or otherwise use all or any part of the Materials in any way for any public or commercial purpose;
• trespass, break into, access, use or attempt to trespass, break into, access or use any other parts of LocalMotion’s servers, and/or any data areas for which you have not been authorised to access or use;
• upload, post, publish, transmit, reproduce, or distribute in any way, any component of the Site itself or any Material obtained through the Site which is protected by copyright, or other proprietary right, or create derivative works with respect thereto;
• interfere with or disrupt networks connected to the Site or violate the regulations, policies or procedures of such networks;
• attempt to gain unauthorised access to the Site, other user’s accounts or Passwords, computer systems or networks connected to the Site, through password mining or any other means.

Privacy Policy

LocalMotion holds onto to some of your personal data for the purpose of administering our skills based volunteering programmes and to keep you updated on new volunteering opportunities. Please see our Privacy Policy for further information.

Social Media Policy

LocalMotion uses social media technologies and platforms in the course of our activities, such as Facebook, Instagram and LinkedIn. Social media allows LocalMotion to communicate with our supporters and other groups and/or individuals who share LocalMotion’s values. The use of social media is primarily used for us to share information, but if any personal data is collected, it will be in line with our Privacy Policy and subject to the terms and guidelines of the relevant social media platform.

Notwithstanding the conditions set out in the Intellectual Property & Use of Material section, you are permitted to share information that is disseminated via LocalMotion’s social media platforms, provided that (i) LocalMotion’s name remains visible; (ii) you do not modify the information and/or material in any way, shape or form. These permissions do not extend to any third party material that may be shared by LocalMotion to its social media platforms.
